Welcome to Posta AI. By creating an account and using our services, you agree to these Terms of Use. Please read them carefully before proceeding.

1. What is Posta AI

Posta AI is a content automation platform for Instagram that uses artificial intelligence to generate and publish carousels automatically at the times configured by the user.

2. Eligibility

• You must be at least 18 years old to use Posta AI.
• You must have a valid Instagram account and the rights needed to publish the generated content.
• You are responsible for keeping your login credentials confidential.

3. Plans and payments

Posta AI offers paid plans with recurring monthly billing:

• Starter: R$ 97/month
• Pro: R$ 197/month
• Agency: R$ 497/month

Fees are charged in Brazilian reais (BRL) by credit card, processed by Stripe. Billing occurs on the sign-up date and renews monthly on the same date.

4. Cancellation and refunds

• You can cancel your subscription at any time from the platform dashboard.
• Cancellation takes effect at the end of the period already paid — you keep access until the end of the cycle.
• Refunds: We offer a full refund within 7 days of the first charge, upon request by email.
• No refunds are given for cancellations after the first 7 days of a billing cycle.

5. Acceptable use

By using Posta AI, you agree not to:

• Publish content that violates the Instagram Community Guidelines or Meta's Terms of Service.
• Use the platform for spam, phishing, disinformation, or misleading content.
• Publish content that is illegal, defamatory, discriminatory, or that promotes violence.
• Attempt to bypass the platform's technical or security limitations.
• Resell or sublicense access to the platform without express authorization.

6. AI-generated content

Posta AI uses artificial intelligence models (Anthropic Claude) to generate text and selects images from licensed stock libraries (Pexels). You are solely responsible for:

• Reviewing the content published to your account.
• Ensuring the generated content complies with Instagram's policies and applicable law.
• Any consequences arising from the content published on your behalf.

Posta AI does not guarantee that AI-generated content will always be accurate, up to date, or suitable for every niche.

7. Service availability

We are committed to keeping the service available and functional, but we do not guarantee uninterrupted availability (99.9% uptime as a target). The service may become temporarily unavailable due to:

• Scheduled maintenance (announced in advance whenever possible).
• Failures in third-party services (Instagram API, Stripe, Cloudinary).
• Events beyond our control (force majeure).

8. Limitation of liability

Posta AI is not responsible for:

• Bans, suspensions, or restrictions applied to your Instagram account by Meta.
• Loss of followers, reach, or revenue resulting from the published content.
• Instagram API failures that prevent scheduled posts.
• Indirect, incidental, or consequential damages of any kind.

Our maximum liability is limited to the amount paid over the last 3 months of subscription.

9. Intellectual property

Posta AI's code, design, brand, and other assets are our exclusive property. The content generated for your account belongs to you, provided you comply with these terms.

10. Termination

We reserve the right to suspend or terminate your account without prior notice in case of violation of these Terms, fraudulent use, or behavior that harms other users or the platform.

11. Changes to these terms

We may update these Terms from time to time. You will be notified by email at least 15 days in advance before significant changes take effect. Continued use after that period constitutes acceptance of the new conditions.

12. Governing law and jurisdiction

These Terms are governed by Brazilian law. The courts of the Judicial District of São Paulo/SP are elected to settle any disputes, with express waiver of any other, however privileged it may be.
